{"id":28984,"date":"2026-05-07T16:42:48","date_gmt":"2026-05-07T16:42:48","guid":{"rendered":"https:\/\/www.press7.tv\/?p=28984"},"modified":"2026-05-07T16:42:48","modified_gmt":"2026-05-07T16:42:48","slug":"specialja-reagon-ndaj-raportit-te-avokatit-te-popullit-ne-kosove","status":"publish","type":"post","link":"https:\/\/www.press7.tv\/?p=28984","title":{"rendered":"Specialja reagon ndaj raportit t\u00eb Avokatit t\u00eb Popullit n\u00eb Kosov\u00eb"},"content":{"rendered":"\n    <div class=\"xs_social_share_widget xs_share_url before_content \t\tmain_content  wslu-style-2 wslu-share-box-shaped wslu-fill-colored wslu-share-m-5 wslu-none wslu-share-vertical wslu-theme-font-no wslu-main_content\">\n\n\t\t\n        <ul>\n\t\t\t        <\/ul>\n    <\/div> \n<p>Dhomat e Specializuara t\u00eb Kosov\u00ebs (DhSK) n\u00eb Hag\u00eb kan\u00eb reaguar ndaj raportimeve dhe deklaratave t\u00eb Avokatit t\u00eb Popullit t\u00eb Kosov\u00ebs lidhur me raportin e p\u00ebrgatitur nga Komiteti p\u00ebr t\u00eb Drejtat e Njeriut i Dhom\u00ebs s\u00eb Avokat\u00ebve t\u00eb Anglis\u00eb dhe Uellsit p\u00ebr procedurat gjyq\u00ebsore t\u00eb k\u00ebsaj Gjykate.<\/p>\n<p>Z\u00ebdh\u00ebn\u00ebsja e DhSK-s\u00eb, Angela Griep tha se raporti n\u00eb fjal\u00eb nuk p\u00ebrmban asnj\u00eb konstatim se ndonj\u00eb vendim i gjykat\u00ebsve ka shkelur t\u00eb drejtat e t\u00eb akuzuarve dhe as nuk arrin n\u00eb p\u00ebrfundimin se jurisprudenca e k\u00ebsaj gjykate bie ndesh me praktik\u00ebn e Gjykat\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut apo tribunaleve t\u00eb tjera nd\u00ebrkomb\u00ebtare, p\u00ebrfshir\u00eb Tribunalin Penal Nd\u00ebrkomb\u00ebtar p\u00ebr ish-Jugosllavin\u00eb, raporton \u201cBetimi p\u00ebr Drejt\u00ebsi\u201c.<\/p>\n<p>Z\u00ebdh\u00ebn\u00ebsit e Dhomave t\u00eb Specializuara theksuan se raporti nuk konstaton as q\u00eb vendimet mbi paraburgimin kan\u00eb qen\u00eb n\u00eb kund\u00ebrshtim me konventat p\u00ebr t\u00eb drejtat e njeriut.<\/p>\n<p>\u201cN\u00eb raport trajtohet disponueshm\u00ebria efektive e mjeteve juridike n\u00eb Dhomat e Specializuara dhe theksohet se shum\u00eb \u00e7\u00ebshtje ende jan\u00eb duke u shqyrtuar nga gjykat\u00ebsit dhe mund t\u00eb apelohen n\u00eb instanca m\u00eb t\u00eb larta\u201d, thuhet n\u00eb reagim.<\/p>\n<p>Sipas DhSK-s\u00eb, shum\u00eb nga \u00e7\u00ebshtjet e ngritura nga Avokati i Popullit dhe t\u00eb trajtuara n\u00eb raport bazohen kryesisht n\u00eb argumentet e paraqitura nga ekipet mbrojt\u00ebse, nd\u00ebrsa aty nuk p\u00ebrfshihen q\u00ebndrimet e Prokuroris\u00eb, t\u00eb mbrojtjes s\u00eb viktimave apo arsyetimet konkrete t\u00eb paneleve gjyq\u00ebsore.<\/p>\n<p>Po ashtu, n\u00eb reagim thuhet se vet\u00eb raporti pranon shprehimisht se shum\u00eb nga aspektet e trajtuara jan\u00eb ende n\u00eb proces diskutimi juridik dhe p\u00ebr to ende nuk ka vendime p\u00ebrfundimtare nga gjykat\u00ebsit.<\/p>\n<p>Dhomat e Specializuara rikujtuan edhe rolet e pal\u00ebve n\u00eb proces gjyq\u00ebsor, duke theksuar se mbrojtja p\u00ebrfaq\u00ebson interesat e t\u00eb akuzuarve, mbrojtja e viktimave p\u00ebrfaq\u00ebson viktimat pjes\u00ebmarr\u00ebse, nd\u00ebrsa Prokuroria ka detyrimin t\u00eb v\u00ebrtetoj\u00eb akuzat e ngritura.<\/p>\n<p>\u201cVet\u00ebm trupi gjykues vendos p\u00ebr faktet, vler\u00ebson provat dhe p\u00ebrcakton n\u00ebse faj\u00ebsia \u00ebsht\u00eb provuar p\u00ebrtej dyshimit t\u00eb arsyesh\u00ebm.
