Sipas saj, ky udh\u00ebzim kufizon lirit\u00eb dhe t\u00eb drejtat kushtetuese t\u00eb vajzave q\u00eb mbajn\u00eb mbules\u00eb fetare, nd\u00ebrsa Kushtetuta parasheh se kufizime t\u00eb tilla mund t\u00eb vendosen vet\u00ebm me ligj.<\/p>\n<p>\u201cArrita\u201d kishte theksuar se n\u00eb kat\u00ebr vjet\u00ebt e fundit ka pranuar shum\u00eb ankesa nga vajza t\u00eb p\u00ebrjashtuara ose t\u00eb pezulluara nga shkollat publike p\u00ebr shkak t\u00eb bartjes s\u00eb shamis\u00eb.<\/p>\n<p>N\u00eb arsyetimin e vendimit, Supremja theksoi se MASHTI ka autorizim t\u00eb qart\u00eb ligjor p\u00ebr t\u00eb p\u00ebrcaktuar rregulla p\u00ebr sjelljen dhe veshjen e nx\u00ebn\u00ebsve, n\u00eb baz\u00eb t\u00eb Ligjit p\u00ebr Arsimin Parauniversitar dhe Ligjit p\u00ebr Arsimin dhe Aft\u00ebsimin Profesional.<\/p>\n<p>Prandaj, ndalimi i uniform\u00ebs fetare n\u00eb shkolla konsiderohet n\u00eb p\u00ebrputhje me ligjin dhe hierarkin\u00eb normative\u201d, thuhet n\u00eb vendim.<\/p>\n<p>Gjykata shtoi se kufizimi i manifestimit fetar n\u00eb institucionet arsimore nuk bie ndesh me Kushtetut\u00ebn, duke u mb\u00ebshtetur edhe n\u00eb praktikat e Gjykat\u00ebs Kushtetuese t\u00eb Kosov\u00ebs dhe Gjykat\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut (GJEDNJ).<\/p>\n<p>N\u00eb vendimin e saj, Supremja kujtoi se liria fetare \u00ebsht\u00eb \u201cnj\u00eb \u00e7\u00ebshtje e nd\u00ebrgjegjes individuale\u201d, por jo \u00e7do veprim i motivuar nga feja g\u00ebzon mbrojtje absolute.
