N\u00eb procesin penal p\u00ebr krime lufte KGJK-ja detyrohet ta paguaj\u00eb 48 mij\u00eb e 800 euro p\u00ebr d\u00ebm jomaterial dhe 6 mij\u00eb e 216 euro p\u00ebr d\u00ebm material, si dhe 150 euro t\u00eb tjera n\u00eb em\u00ebr t\u00eb shpenzimeve p\u00ebr pako ushqimore gjat\u00eb q\u00ebndrimit n\u00eb paraburgim. Po ashtu, KGJK-ja obligohet q\u00eb n\u00eb em\u00ebr t\u00eb shpenzimeve t\u00eb procedur\u00ebs t\u2019ia paguaj\u00eb Limajt 2 mij\u00eb e 48 euro, raporton \u201cBetimi p\u00ebr Drejt\u00ebsi\u201c.<\/p>\n<p>Deputeti Limaj, kryetar i Nism\u00ebs Socialdemokrate, m\u00eb 13 korrik 2017 pati parashtruar padi p\u00ebr kompensim. Sipas vendimit, n\u00eb padi padit\u00ebsi Limaj ka deklaruar se p\u00ebr shkak t\u00eb zbatimit t\u00eb procedur\u00ebs s\u00eb padrejt\u00eb penale ndaj tij, n\u00eb m\u00ebnyr\u00eb t\u00eb kund\u00ebrligjshme ka q\u00ebndruar n\u00eb paraburgim 85 dit\u00eb (nga 24 n\u00ebntori 2012 deri m\u00eb 8 mars 2013) dhe n\u00eb arrest sht\u00ebpiak 384 dit\u00eb.<\/p>\n<p>Limaj \u00ebsht\u00eb ankuar se ishte detyruar t\u00eb angazhonte avokat\u00eb mbrojt\u00ebs, p\u00ebrfshir\u00eb nj\u00eb nd\u00ebrkomb\u00ebtar, me shpenzime personale, gjat\u00eb nj\u00eb procesi penal kompleks dhe t\u00eb padrejt\u00eb p\u00ebr krime lufte, n\u00eb t\u00eb cilin u shpall i pafajsh\u00ebm. Limaj \u00ebsht\u00eb ankuar edhe p\u00ebr d\u00ebmtim t\u00eb reputacionit dhe r\u00ebnie t\u00eb imazhit, q\u00eb sipas tij, u v\u00ebrtetua me rezultatet zgjedhore para dhe pas proceseve.<\/p>\n<p>P\u00ebr 13 vjet, Limaj \u00ebsht\u00eb p\u00ebrballur me tri aktakuza p\u00ebr krime lufte, n\u00eb gjykimet n\u00eb Tribunalin e Hag\u00ebs, n\u00eb rastin Kle\u00e7ka nga EULEX, dhe n\u00eb rastin Bellanica, ku n\u00eb t\u00eb gjitha \u00ebsht\u00eb shpallur i pafajsh\u00ebm. Krahas k\u00ebsaj, Limaj ka shtuar po ashtu se p\u00ebrve\u00e7 k\u00ebtyre, jan\u00eb zhvilluar edhe dy procedura penale n\u00eb lidhje me rastin MTPH 1 dhe 2, p\u00ebr t\u00eb cilat gjithashtu \u00ebsht\u00eb shpallur i pafajsh\u00ebm.<\/p>\n<p>KGJK-ja nd\u00ebrkaq nuk ka kontestuar baz\u00ebn p\u00ebr kompensim, por jo shum\u00ebn.<\/p>\n<p>KGJK-ja, sipas vendimit, i ka Limajt ofruar kompensim p\u00ebr q\u00ebndrim n\u00eb paraburgim prej 1 mij\u00eb e 425 euro dhe p\u00ebr arrest sht\u00ebpiak shum\u00ebn prej 5 mij\u00eb e 760 euro.<\/p>\n<p>P\u00ebr q\u00ebndrimin n\u00eb paraburgim dhe arrest sht\u00ebpiak, mbrojtja e Limajt kishte k\u00ebrkuar 2.95 milion\u00eb euro n\u00eb em\u00ebr t\u00eb d\u00ebmit material dhe 710 mij\u00eb n\u00eb em\u00ebr t\u00eb d\u00ebmit material.<\/p>\n<p>N\u00eb fund t\u00eb vendimit, Gjykata ka sqaruar se padit\u00ebsit Limaj do t\u2019i paguhet shuma e aprovuar me kamat\u00eb ligjore prej 8% nga dita e marrjes s\u00eb aktgjykimit m\u00eb 20 qershor 2025 e deri n\u00eb p\u00ebrmbushje definitive p\u00ebr d\u00ebmin jomaterial, nd\u00ebrsa p\u00ebr at\u00eb material prej 8% nga dita e parashtrimit t\u00eb padis\u00eb m\u00eb 13 korrik 2017 e deri n\u00eb pages\u00ebn definitive.<\/p>\n<p>N\u00eb em\u00ebr t\u00eb shpenzimeve t\u00eb procedur\u00ebs kontestimore, Themelorja obligoi t\u00eb paditur\u00ebn q\u00eb padit\u00ebses t\u2019ia kompensoj\u00eb 2 mij\u00eb e 48 euro e 8 cent\u00eb.<\/p>\n<p>Shumat e kompensimit, p\u00ebrfshir\u00eb me kamat\u00ebn ligjore do t\u00eb paguhen pasi q\u00eb vendimi t\u00eb b\u00ebhet i plotfuqish\u00ebm,<\/p>\n<p>Gjykata ka njohur t\u00eb drejt\u00ebn e ankes\u00ebs p\u00ebr pal\u00ebt e pak\u00ebnaqura n\u00eb afat prej 15 dit\u00ebsh pasi q\u00eb pal\u00ebt t\u00eb marrin vendimin n\u00eb form\u00eb t\u00eb shkruar.<\/p>\n<p>I kontaktuar nga \u201cBetimi p\u00ebr Drejt\u00ebsi\u201d, avokati i Limajt, Tahir Rrecaj tha se kan\u00eb pranuar vendimin dhe kan\u00eb parashtruar ankes\u00eb lidhur me shumat e aprovuara p\u00ebr kompensim.<\/p>\n<p>\u201cPo, kemi pranuar vendimin dhe kemi paraqitur ankes\u00eb p\u00ebr shumat e kompensimit\u201d, u shpreh Rrecaj. \/Betimip\u00ebrDrejt\u00ebsi<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gjykata Themelore n\u00eb Prishtin\u00eb e ka miratuar pjes\u00ebrisht padin\u00eb e Fatmir Limajt dhe e ka detyruar K\u00ebshillin Gjyq\u00ebsor t\u00eb Kosov\u00ebs q\u00eb ta kompensoj\u00eb me m\u00eb shum\u00eb se 57 mij\u00eb euro p\u00ebr q\u00ebndrimin pa t\u00eb drejt\u00eb n\u00eb paraburgim dhe arrest sht\u00ebpiak.
